Getting together can be a very exciting time. You may be buying or renting a home together. You may be engaged and due to marry in the future or have recently married. You may have come from another relationship and be bringing two families together.
Seeing a lawyer may be the last thing on your list however it is important to understand your legal rights when getting together and protect your position and particularly the position of any dependent children into the future.
A pre-nuptial agreement is a contract entering into prior to marriage, which sets out how your assets will be divided in the event the marriage breaks down. A post-nuptial agreement works to achieve the same aim, but it is entered into after you have married.
Nuptial agreements are not always enforceable however where they are well drafted, agreements are more likely to be upheld by the Court.
